Power of Attorney Attestation Between India and the UAE: Complete Guide for Both Directions
Where you sign the Power of Attorney decides its route. Signed in India for the UAE, it goes through MEA, the UAE Embassy and UAE MOFA. Signed in the UAE for India, it goes through the Indian Consulate, then Indian stamp rules.
Power of Attorney attestation between India and the UAE runs in two directions. Most POA problems we see aren’t about attestation at all. They’re about a POA signed in the wrong place, with the wrong wording, or stamped too late.
This guide covers both directions, with step tables for each. It also explains Kerala’s three-month stamping rule, which catches out many NRI families.
India to UAE vs. UAE to India at a Glance
The two routes share almost nothing. Choose by where the principal will sign, not where the property sits.
| India to UAE | UAE to India | |
| Who signs | Principal living in India | Principal living in the UAE |
| Where it’s signed | Before a notary or lawyer in India | Before the officer at the Indian Consulate’s centre (Dubai) or Embassy (Abu Dhabi) |
| Attestation chain | State authentication, MEA, UAE Embassy, UAE MOFA | Indian Consulate or Embassy attestation |
| UAE MOFA needed? | Yes, as the final step | No, not for use in India |
| Last step | Acceptance by the UAE bank, court or land department | Stamping in India, then registration if the transaction needs it |
| Typical uses | UAE company matters, bank accounts, court cases | Property sale or management, banking, family matters in India |
| Deadline to watch | None set by law, but plan for weeks | Kerala: stamp within 3 months of the POA reaching Kerala |
What POA Attestation Does, and Doesn’t Do
Attestation proves the signatures and seals are genuine. It doesn’t prove the POA gives the right powers for your transaction.
A land department or bank can still reject a perfectly attested POA. The usual reason is wording that’s too vague for the specific deal.
Get the receiving authority’s preferred format before you sign. That one step saves more time than anything else in this guide.
Direction 1: POA Signed in India for Use in the UAE
A POA signed in India needs four stamps before a UAE authority will accept it. Those are state authentication, MEA, the UAE Embassy and finally UAE MOFA.
| Step | What happens | Where | Watch out for |
| 1 | Draft the POA for the exact UAE purpose | Your lawyer in India | Ask the UAE bank or authority for its format first |
| 2 | Sign before a notary or lawyer | In India | The UAE Embassy requires signing before a legal authority before MEA |
| 3 | State-level authentication | State Home Department or other designated office | The office depends on the state and document type |
| 4 | MEA attestation | Ministry of External Affairs | MEA attests only after the state step |
| 5 | UAE Embassy attestation | UAE Embassy, New Delhi (electronic) | Heat-sealed documents aren’t accepted |
| 6 | UAE MOFA attestation | UAE MOFA, online | Personal POA: AED 150. Commercial POA: AED 2,000. |
| 7 | Arabic translation, if requested | Legal translator in the UAE | UAE courts and land offices often ask for Arabic |
Personal or commercial: it changes the fee
A POA with commercial content is treated as a commercial document. The UAE Embassy in New Delhi says so directly.
That matters at UAE MOFA, where commercial documents cost AED 2,000 instead of AED 150. A POA to run a company or sign contracts usually falls on the commercial side.
Why an apostille won’t work here
India is an Apostille Convention member, but the UAE isn’t. An apostilled Indian POA still needs the UAE Embassy and MOFA steps.
Ask for “attestation for the UAE” at MEA, not an apostille. Our Indian certificate attestation in the UAE page explains the Indian chain step by step.
Translation for UAE authorities
Many UAE courts and land departments want the POA in Arabic. Plan for a legal translation after MOFA attestation.
Our legal translation services cover Arabic translations accepted by UAE authorities. Ask the receiving office first, so you translate only once.
Direction 2: POA Signed in the UAE for Use in India
Sign it at the Indian Consulate’s attestation centre, then stamp it in India. For use in India, you don’t need UAE MOFA attestation.
India’s Registration Act accepts a POA from a principal living abroad if an Indian Consul authenticates it. That’s Section 33(1)(c), and it’s why the consular route is the standard one.
| Step | What happens | Where | Watch out for |
| 1 | Get the Indian recipient’s preferred format | Sub-Registrar, bank or lawyer in India | Property POAs need precise property details |
| 2 | Draft and type the POA | Your lawyer | Names must match passports exactly |
| 3 | Book an attestation appointment | Indian Consulate’s centre in Dubai, or the Embassy in Abu Dhabi | Bring your original passport and a copy |
| 4 | Sign before the officer | At the centre | Don’t sign in advance. You must sign in the officer’s presence. |
| 5 | Collect the attested POA | Same centre | Check every name and date before you leave |
| 6 | Courier the original to India | Tracked, signed-for courier | Keep scans. Note the date it reaches the state. |
| 7 | Pay stamp duty or get adjudication | Collector or designated officer in the state | Kerala: within 3 months of the POA arriving |
| 8 | Register, if the transaction needs it | Sub-Registrar’s office | A property sale usually needs a registered POA |
Signing at the Indian Consulate in Dubai
You must sign in front of the officer. SG IVS Global runs the Consulate’s attestation services. It says a POA must be signed in its officer’s presence.
Bring your original passport and a photocopy. If you’re a company submitting on someone’s behalf, bring an authorisation letter as well.
Is UAE MOFA attestation needed afterwards?
Not for use in India. The Indian Consul’s attestation is what Indian authorities rely on.
UAE MOFA attestation matters only if the same POA will also be used before a UAE authority. That’s rare for an India-bound POA.
Kerala POA Adjudication: The Three-Month Rule
A POA signed abroad must be stamped within three months of first reaching Kerala. That’s Section 18 of the Kerala Stamp Act, 1959.
The clock starts when the document arrives in Kerala, not when you sign it in Dubai. Note the courier delivery date and keep the receipt.
| Point | What the law says |
| Which documents | Instruments chargeable with duty, executed only outside India |
| Deadline | Within three months after first received in the State of Kerala |
| Who stamps it | The Collector, if a private person can’t stamp it correctly |
| Who acts as Collector | The Revenue Divisional Officer (RDO), under Kerala government delegation |
| Who decides the duty | The Collector, through adjudication under Section 31 |

A Kerala High Court case every NRI should know
In Anitha Rajan v. RDO Thrissur (AIR 2010 Ker 153), a seller in Dubai signed a POA at the Indian Consulate. The RDO rejected it for missing the three-month deadline.
The court disagreed. The POA was already on stamp paper of the correct value, so adjudication wasn’t needed at all. A summary is available from BCAJ.
What this means for you
If the correct duty is paid, the deadline doesn’t bite. If it isn’t, get to the RDO within three months.
Missing the deadline makes the process harder and can add penalties. If the POA is for a property sale, ask the Sub-Registrar about duty before you even sign.
Documents You’ll Need
Bring identity proof for both sides and the transaction details. The checklist below covers most cases.
| Document | Direction 1 (India to UAE) | Direction 2 (UAE to India) |
| Draft POA, typed | Yes | Yes |
| Principal’s original passport and copy | Yes | Yes |
| UAE visa or Emirates ID copy | No | Usually |
| Attorney’s ID copy (Aadhaar or passport) | Yes | Yes |
| Property or transaction details | Yes, for property and company POAs | Yes, for property POAs |
| Witness details | If the format needs them | If the format needs them |
| Passport-size photos | Sometimes | Sometimes |
| Arabic translation | Often, for UAE courts and land offices | No |
Using a POA for Your Certificates
A POA can let a family member handle your certificates in India. That’s useful when you’re in the UAE and your degree is still at home.
A relative can collect the degree from the university and start the state step for you. Our degree certificate attestation service can then take it through MEA, the UAE Embassy and MOFA.
Check first whether the university accepts an authorisation letter instead. A simple letter is often enough for collection.
Six Mistakes That Delay POA Attestation
- Signing a vague, general POA. Property and banking deals need specific powers.
- Signing before your consular appointment. You must sign in front of the officer.
- Asking MEA for an apostille for UAE use. The UAE needs the embassy route.
- Paying for UAE MOFA on an India-bound POA. Indian authorities don’t need it.
- Missing Kerala’s three-month window. The clock starts when the POA reaches Kerala.
- Names that don’t match passports. Every spelling must match exactly.
Frequently Asked Questions
How do I attest a POA from India for use in the UAE?
Sign before a notary in India, then get state authentication, MEA, UAE Embassy and UAE MOFA attestation. Add an Arabic translation if the UAE authority asks.
How do I make a POA in Dubai for use in India?
Sign it before the officer at the Indian Consulate’s attestation centre in Dubai. Then courier it to India for stamping and registration.
Is Indian Consulate attestation enough for a POA in India?
For attestation, yes. Indian law accepts a consul-authenticated POA. You still need stamp duty and, for property sales, registration.
Do I need UAE MOFA attestation after the Indian Consulate?
No, not for use in India. You’d need it only if a UAE authority will rely on the same POA
What is the deadline for stamping a foreign POA in Kerala?
Three months from when it first reaches Kerala, under Section 18 of the Kerala Stamp Act.
Does a POA need translation?
For UAE authorities, usually into Arabic. For India, an English POA normally works.
