Name Mismatch Across Passport and Certificates: The “One and the Same Person” Affidavit in the UAE
A “One and the Same Person” affidavit can explain a small name difference, but it won’t fix every mismatch. For MOHESR equivalency or a legal name change, you need a government-issued document.
Name mismatches are one of the most common reasons we see files stall. An initial on the degree, a full name on the passport, and suddenly nothing moves.
The right fix depends on two things: what kind of mismatch you have, and which authority is checking it. This guide shows you both.
Name Mismatch Types at a Glance
Find your mismatch in this table first. The fix depends on the type, not on how small the difference looks.
| Mismatch type | Example (certificate vs. passport) | Best fix | Is an affidavit enough? |
| Missing or short initials | “A. Kumar” vs. “Arun Kumar” | University letter linking both names | Often, for employers |
| Expanded initials | “K. S. Nair” vs. “Kailas Suresh Nair” | University letter, plus affidavit | Often, for employers |
| Different name order | “Kumar Arun” vs. “Arun Kumar” | University confirmation of its format | Sometimes |
| Spelling error | “Mohd. Rafeeq” vs. “Mohammed Rafeek” | Corrected certificate from the university | Rarely |
| Maiden vs. married name | “Anjali Menon” vs. “Anjali Nair” | Attested marriage certificate | No. Use the marriage record. |
| Legal name change | Old name vs. new name | Gazette notification or court order | No |
| Old vs. renewed passport | Different names across passports | Old passport, or an endorsed new one | No |
What Is a “One and the Same Person” Affidavit?
It’s a sworn statement that two or more versions of a name belong to one person. You list each version and the document it appears on.
For example, your passport says “Anil Kumar Raj” and your degree says “Anil Raj.” The affidavit states, under oath, that both are you.
It doesn’t change any record. Your degree still says “Anil Raj” after the affidavit, so the affidavit has to travel with it.
When an Affidavit Works, and When It Doesn’t
An affidavit explains a difference. It doesn’t prove a legal change. That’s why some authorities accept it and others don’t.
| Who is checking | Affidavit accepted? | What they actually need |
| MOHESR equivalency | No, not on its own | A government-issued document confirming the name change: birth record, marriage record or passport with an official endorsement |
| UAE MOFA attestation | Not relevant | Your application details must match the document exactly |
| Private employer HR | Often | Affidavit plus passport, sometimes a university letter |
| Professional licensing (DHA, DOH, MOHAP) | Rarely on its own | Corrected certificate or government name-change proof |
| Indian passport services | Yes, for minor variations | Affidavit in the prescribed format |
| Legal name change (any purpose) | No | Gazette notification or court order |
The MOHESR rule comes from its own equivalency FAQ. It names three accepted documents, and an affidavit isn’t one of them.
Fix It at the Source First
The strongest fix is a corrected record from the authority that issued it. An affidavit explains a mismatch; a correction removes it.
Before drafting any affidavit, ask your university one question. Can it correct the certificate, or confirm both names in an official letter?
Missing initials or a short name
Ask the university for a letter linking the short form to your full name. This is common on South Indian degrees, where initials replace the family name.
The letter should be on letterhead, signed by the registrar and quote your enrolment number. Pair it with an affidavit if your employer asks for one.
Spelling errors
Get the certificate corrected. An affidavit can’t fix a wrong record.
If the university made the mistake, it should reissue the certificate. Our guide to duplicate, reissued and name-corrected degrees covers that process.
Different name order
Ask the university to confirm its name format in writing. Some institutions print the surname first as standard.
If that’s the only difference, a university letter usually settles it. An affidavit is a back-up, not the main proof.
Maiden name vs. married name
Your marriage certificate is the link, not an affidavit. MOHESR lists a marriage record as accepted proof.
The marriage certificate needs its own attestation for UAE use. Indian families can follow our Indian certificate attestation in the UAE guide.
A legal name change
You need the official record of the change. In India, that’s a Gazette of India notification, not just a sworn statement.
The affidavit is usually the first step of the Indian name-change process. The gazette notification is the document authorities accept.
How to Get an Affidavit Ready for UAE Use
Where you sign it decides the attestation route. There are two routes, and each ends at a different place.
| Signed in India | Signed in the UAE | |
|---|---|---|
| Where to sign | Before a notary or oath commissioner in India | Indian Consulate in Dubai, through its SG centre in Oud Metha, or the Embassy in Abu Dhabi |
| Format | Typed, on stamp paper as required by the state | Typed only. Handwritten affidavits aren’t accepted. |
| Next steps | State attestation, then MEA, then UAE Embassy (electronic), then UAE MOFA | Consulate attestation, then UAE MOFA if a UAE authority needs it |
| Best for | Affidavits needed alongside Indian documents | When you’re already in the UAE |
The Indian Consulate in Dubai lists sworn affidavits among its attestation services. Book through its outsourced agency before you go.
Step 1: List every name version exactly
Write down each version of your name exactly as printed. Note which document it appears on.
Never introduce a new spelling that isn’t on any document. The affidavit should only link names that already exist.
Step 2: Check the receiving authority accepts an affidavit
Use the table above. If MOHESR or a licensing body is involved, get the government document instead.
This check saves you paying for an affidavit and its attestation chain for nothing.
Step 3: Draft the affidavit
A clear affidavit includes these details:
- Your full name exactly as on your current passport
- Your passport number, date of birth and parents’ names
- Each name variant, and the document where it appears
- A statement that all variants refer to you
- The purpose, such as “for attestation and employment in the UAE”
Don’t claim a legal name change if none happened. A false statement in a sworn document is a serious problem.
Step 4: Sign before the authorised official
Sign only in front of the notary or consular officer. Signing beforehand usually means starting again.
Step 5: Complete attestation and translation
Follow the route in the table for where you signed. If any document in the set isn’t in Arabic or English, arrange legal translation services.
Documents to Keep With Your File
Carry the affidavit with the documents it explains. On its own, it proves nothing.
| Document | When to include it |
| Current passport | Always |
| Previous passport | If the name changed between passports |
| Certificate with the different name | Always |
| University letter or corrected certificate | Initials, spelling or name-order issues |
| Attested marriage certificate | Maiden vs. married name |
| Gazette notification or court order | Legal name change |
| One and the Same Person affidavit | Minor variations, where accepted |
| Legal translation | Any document not in Arabic or English |
Name Mismatch on a Degree for UAE Employment
Fix the mismatch before the degree enters the attestation chain. A degree attested with an unresolved mismatch can still fail at MOHESR or licensing.
Attestation and recognition are separate checks. Our degree certificate attestation service pre-checks names before the chain starts, so you don’t pay for steps twice.
Eight Mistakes That Cost Time and Money
- Using an affidavit for MOHESR. It wants a government-issued document.
- Using an affidavit to cover a spelling error. Get the record corrected.
- Handwriting the affidavit. The Indian mission’s centre accepts typed affidavits only.
- Adding a new name version. Only link names already on your documents.
- Skipping the marriage certificate. It’s the accepted link for married names.
- Attesting the degree first, fixing the name later. You’ll pay for the chain twice.
- Sending a laminated or heat-sealed certificate. The UAE Embassy in New Delhi won’t attest it.
- Typing different names across application forms. MOFA expects your details to match the document exactly.
Frequently Asked Questions
Is a One and the Same Person affidavit valid in the UAE?
Yes, for some purposes. Employers often accept it, but MOHESR wants a government-issued document instead.
Does MOHESR accept an affidavit for a name mismatch?
No. Its FAQ asks for a government-issued document: a birth record, marriage record or endorsed passport.
Can an affidavit correct a spelling mistake on my degree?
No. An affidavit doesn’t change the record. Ask your university to correct and reissue the certificate.
What if my name changed after marriage?
Use your attested marriage certificate as the link. It’s accepted proof for MOHESR.
Can I make the affidavit in Dubai?
Yes. The Indian Consulate in Dubai attests sworn affidavits through its outsourced centre. They must be typed.
Do I attest the affidavit before or after the degree?
Prepare both together. The affidavit should travel with the degree through the same steps.
